01 Acceptance of Terms

By accessing or using drown's services ("Services"), including but not limited to visiting this website ("Website") or adding the drown Bot ("Bot") to your Discord server, you ("User") hereby acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Agreement").

If you do not agree to these terms in their entirety, you are expressly prohibited from using the Services and must discontinue use immediately.

02 Definitions

In this Agreement:

  • "drown," "we," "us," and "our" refer to drown and its affiliates, directors, officers, and agents.
  • "Services" means all products, features, applications, websites, or other services operated by drown.
  • "Bot" refers to the drown Discord bot and all associated functionality.
  • "User," "you," and "your" refer to any individual or entity using our Services.
  • "Subscription" refers to any paid access plan granting use of the Bot in a Discord server.

03 Eligibility

3.1 You must be at least 14 years of age to use the Services, in accordance with Discord's Terms of Service. By using the Services, you represent and warrant that you meet this requirement.
3.2 If you are using the Services on behalf of an organization or Discord server, you represent that you have the authority to bind that entity to this Agreement.
3.3 drown reserves the right to refuse service to any User at any time, for any reason, with or without prior notice.

04 Subscriptions & Billing

4.1 drown is a premium, paid service. Access to the Bot requires an active subscription. Two subscription types are available: a monthly plan at $1.60 USD/month and a one-time lifetime plan at $11.00 USD.
4.2 The monthly subscription is indefinite — it does not expire after a set number of months and will continue until cancelled.
4.3 Payments are accepted via: Ethereum, Litecoin, UPI. All purchases must be initiated through a ticket in our Discord server.
4.4 Failure to maintain an active subscription will result in the Bot being removed from your server at the end of the current billing period. Configuration data is retained for 30 days after lapse.

05 Transfers & Refunds

5.1 Each subscription includes one (1) server transfer. To initiate a transfer, open a ticket in the Discord server and provide: the Old Server ID & Invite, New Server ID & Invite, and Proof of Payment.
5.2 drown reserves the right to reject any transfer request if the destination server is found to violate these Terms or Discord's policies.
5.3 Once a transfer has been used, no additional transfers are permitted under that subscription. A new subscription must be purchased for any subsequent server.
5.4 Refund Policy. Refund requests must be submitted via ticket within 7 days of purchase. Refunds are evaluated on a case-by-case basis and are not guaranteed. No refunds will be issued after this window under any circumstances.
Transfer requests must be made by the original purchaser on record. Requests from unauthorized parties will be refused and may result in account termination.

06 Compliance with Laws & Discord Policies

6.1 The User shall comply with all applicable local, state, national, and international laws and regulations in connection with use of the Services.
6.2 Use of the Services is additionally subject to Discord's Terms of Service and Community Guidelines. Any violation thereof constitutes a simultaneous violation of this Agreement.
6.3 Users shall promptly report any violations of applicable laws, regulations, or Discord policies to drown via our Discord support server.

07 Prohibited Activities

Users are expressly prohibited from engaging in the following activities:

  • a.Violating Discord's Terms of Service or Community Guidelines while using the Bot;
  • b.Reproducing, duplicating, copying, selling, or reselling any portion of the Bot's functionality or code;
  • c.Facilitating, enabling, or encouraging others to reproduce drown's services or features;
  • d.Exploiting bugs, glitches, or vulnerabilities in the Bot's functionality — any discovered exploits must be reported immediately;
  • e.Operating a Discord server that has been previously terminated for policy violations;
  • f.Organizing, participating in, or encouraging harassment, "raids," or targeted attacks against drown or its staff;
  • g.Attempting to exploit, hack, damage, or gain unauthorized access to drown's website or systems;
  • h.Scraping, collecting, or harvesting any data from drown's website or services for unauthorized purposes;
  • i.Copying, reproducing, or claiming ownership of any content, design elements, or proprietary information belonging to drown.

08 Enforcement

8.1 Enforcement Rights. drown reserves the right, at its sole and absolute discretion, to:
  • a.Terminate access to the Services, temporarily or permanently, with or without prior notice;
  • b.Remove, disable, or restrict the availability of any content;
  • c.Take appropriate legal action against Users who violate these terms;
  • d.Pursue any and all remedies available at law or in equity for violations of this Agreement.
8.2 No Waiver. drown's failure to enforce any right or provision of this Agreement shall not be considered a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of drown.

09 Disclaimer of Warranties

9.1 The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 drown does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the Services is at your sole risk.

10 Limitation of Liability

10.1 To the fullest extent permitted by applicable law, drown shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
10.2 drown's total aggregate liability to any User for any claim arising from or related to the Services shall not exceed the total amount paid by that User to drown in the three (3) months preceding the claim.

11 Modifications to Terms

11.1 drown reserves the right to modify these Terms at any time. Updated Terms will be posted to this page with a revised effective date. Continued use of the Services after any modification constitutes your acceptance of the updated Terms.
11.2 If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force and effect.
